These Terms and Conditions ("Terms") govern your access to and use of the Renti-Fi website, mobile applications, administrative services, communications, and related marketplace services (collectively, the "Platform").
By creating an account, accessing, or using the Platform, you agree to these Terms and to the Renti-Fi Privacy Policy. If you do not agree, do not use the Platform.
1. About Renti-Fi
Renti-Fi operates an online peer-to-peer rental marketplace that allows people and businesses offering items for rent ("Owners") to connect with people seeking to rent those items ("Renters").
Depending on the transaction, a user may act as an Owner, a Renter, or both. "User," "you," and "your" refer to anyone who accesses or uses the Platform.
Unless expressly stated otherwise:
- Renti-Fi does not own, manufacture, inspect, maintain, warrant, insure, or lease items listed by Owners.
- Renti-Fi is not a party to the separate rental arrangement between an Owner and a Renter, except to the extent Renti-Fi processes payments, manages delivery, administers platform rules, or provides other services described in these Terms.
- Owners remain responsible for their listings and items.
- Renters remain responsible for their use, possession, care, and return of rented items.
2. Eligibility
To use the Platform, you must:
- Be at least 18 years old;
- Have the legal capacity to enter into a binding contract;
- Provide accurate and current information;
- Not be prohibited from using the Platform under applicable law; and
- Comply with these Terms and all Platform policies.
If you use the Platform on behalf of a company or other organization, you represent that you are authorized to bind that organization to these Terms.
Renti-Fi may require identity, age, address, payment, or other verification before allowing access to some features.
3. Accounts and Account Security
You may need an account to list, book, pay for, deliver, receive, message about, or manage rentals.
You agree to:
- Provide complete and accurate account information;
- Keep your information current;
- Maintain the confidentiality of your password, verification codes, and account credentials;
- Use only your own identity and payment information unless you are legally authorized to use another person's information;
- Promptly notify Renti-Fi of suspected unauthorized access; and
- Accept responsibility for activity performed through your account, except where prohibited by law.
You may not transfer, sell, rent, or share your account.
Renti-Fi may require additional verification, including government-issued identification, facial or identity verification, payment verification, or other anti-fraud checks.
4. Owner Responsibilities
Owners are solely responsible for the items they list and must:
- Have the legal right and authority to rent the item;
- Provide complete, accurate, and non-misleading descriptions;
- Clearly disclose the item's condition, defects, limitations, safety risks, included accessories, replacement value, and instructions;
- Use current and accurate photographs;
- Set accurate prices, deposits, availability, and rental conditions;
- Keep listings updated;
- Ensure the item is safe, lawful, functional, and suitable for its stated purpose;
- Complete any legally required inspection, registration, licensing, maintenance, or certification;
- Provide reasonable operating and safety instructions;
- Cooperate with delivery, pickup, return, damage, claim, and dispute procedures; and
- Comply with all laws applicable to the item and rental.
Approval or publication of a listing by Renti-Fi does not mean that Renti-Fi has inspected, endorsed, certified, or guaranteed the item or Owner.
5. Renter Responsibilities
Renters must:
- Review the listing and rental conditions before booking;
- Provide accurate booking, delivery, contact, and payment information;
- Use the item only for lawful and intended purposes;
- Follow all manufacturer, Owner, safety, and operating instructions;
- Use reasonable care and protect the item from damage, theft, misuse, unauthorized access, and loss;
- Not modify, repair, disassemble, sell, sublease, pledge, lend, or transfer the item without written authorization;
- Not allow an unauthorized or unqualified person to use the item;
- Stop using the item if it appears unsafe, damaged, defective, or unlawful;
- Promptly report accidents, damage, loss, theft, malfunction, or safety concerns;
- Preserve relevant evidence, including photographs, videos, receipts, police reports, and communications;
- Return the item on time, with all included parts and accessories, in substantially the same condition received, excluding ordinary wear and tear; and
- Pay all valid amounts arising from the booking.
The Renter is responsible for the item during the rental period and any period of delayed return, subject to applicable law and the circumstances of delivery and custody.
6. Prohibited and Restricted Listings
Users may not list, request, rent, deliver, or use items or services that are illegal, stolen, counterfeit, unsafe, recalled, improperly licensed, or prohibited by Renti-Fi.
Prohibited or restricted categories may include:
- Firearms, ammunition, explosives, and regulated weapons;
- Illegal drugs, controlled substances, drug paraphernalia, and hazardous materials;
- Stolen, counterfeit, or unlawfully obtained property;
- Recalled or dangerously defective products;
- Items that infringe intellectual property or privacy rights;
- Surveillance devices offered for unlawful use;
- Human remains, protected wildlife, or regulated biological materials;
- Adult sexual services or unlawful obscene material;
- Items requiring licenses, permits, insurance, training, or qualifications that the User does not possess;
- Vehicles, equipment, or machinery that cannot lawfully or safely be rented through the Platform; and
- Any item or activity prohibited by law or Platform policy.
Renti-Fi may remove or restrict any listing at its discretion.
7. Bookings and Rental Agreements
A booking request is an offer to rent an item under the listing terms, pricing, dates, delivery terms, cancellation rules, and other conditions shown at checkout.
A booking becomes confirmed when the required authorization or payment is completed and any required Owner approval is obtained.
The Owner and Renter are responsible for reviewing the booking details. Any additional agreement between them must not conflict with these Terms or applicable law.
Renti-Fi may refuse, cancel, delay, or review a booking where necessary for fraud prevention, safety, legal compliance, payment risk, technical errors, item unavailability, or policy enforcement.
8. Prices, Fees, Taxes, and Payment Authorization
The total displayed at checkout may include:
- Rental charges;
- Delivery or pickup charges;
- Taxes;
- Security deposit authorizations or collections;
- Late, extension, cleaning, repair, loss, replacement, administrative, or other charges;
- Platform or service fees, where applicable; and
- Other disclosed amounts.
You authorize Renti-Fi and its payment providers to:
- Charge or authorize your selected payment method;
- Place and release authorization holds;
- Collect amounts due under a booking;
- Correct obvious pricing or calculation errors before completion;
- Process refunds, reversals, credits, transfers, and adjustments; and
- Charge valid post-rental amounts for late return, damage, missing accessories, excessive cleaning, loss, replacement, or other breaches, subject to applicable notice and dispute procedures.
Payments may be processed through third-party payment providers such as Stripe, PayPal, Apple Pay, Google Pay, or other providers made available through the Platform.
Renti-Fi may act as merchant of record for renter payments. Payment processing does not make Renti-Fi the Owner, lessor, manufacturer, or insurer of a listed item.
9. Owner Earnings, Wallets, and Payouts
Where Renti-Fi provides an Owner wallet or payout feature:
- Owner earnings are calculated according to the booking terms and applicable commission structure;
- Taxes, delivery charges, security deposits, payment processing charges, refunds, chargebacks, adjustments, and other amounts may be excluded from Owner earnings;
- Earnings may remain pending until the rental is completed, the item return is confirmed, payment has succeeded, and any applicable review or hold period has expired;
- Renti-Fi may place holds on funds where a dispute, refund, chargeback, fraud review, safety issue, legal requirement, or account restriction exists;
- Duplicate, mistaken, fraudulent, reversed, or otherwise ineligible credits may be corrected or reversed;
- Users must complete any required payment-provider onboarding before withdrawing funds; and
- External payout timing is controlled by the payment provider and financial institutions.
Renti-Fi may use Stripe Connect or another payment provider for Owner onboarding, transfers, and payouts. Renti-Fi does not need to collect or store an Owner's full bank account information when the payment provider handles that information.
A transfer to a connected payment account may occur before the payment provider deposits funds into the Owner's bank account. Bank payout timing and eligibility are subject to the payment provider's rules.
10. Security Deposits and Authorization Holds
Renti-Fi may authorize or collect a security deposit or other hold to cover eligible losses, damage, late return, missing parts, excessive cleaning, unpaid charges, or other booking violations.
An authorization hold is not necessarily an immediate charge. Release timing may depend on the payment provider or bank.
A deposit or hold does not limit the User's liability where valid losses exceed the deposit amount.
11. Delivery, Pickup, and Return
Renti-Fi may provide, arrange, coordinate, or manage delivery and return services. Delivery options, fees, timing, service areas, and procedures may vary.
Users must:
- Provide a safe, lawful, and accessible delivery or pickup location;
- Be available at the agreed time or designate an authorized recipient;
- Inspect the item promptly and document its condition;
- Follow identity, signature, verification, and handoff procedures;
- Not redirect delivery without authorization;
- Package or prepare items as instructed;
- Cooperate with failed delivery, rescheduling, and return procedures; and
- Avoid threatening, abusive, unsafe, or unlawful conduct toward delivery personnel or other Users.
Risk and responsibility may depend on who has custody of the item and the circumstances of the handoff. Renti-Fi may use timestamps, photographs, signatures, location information, messages, and delivery records to assess disputes.
12. Cancellations, Extensions, and Refunds
Cancellation and refund eligibility may depend on:
- The cancellation policy shown for the booking;
- How long before the rental the cancellation occurs;
- Whether the Owner accepted or prepared the item;
- Whether delivery has begun or occurred;
- Item availability or condition;
- User fault;
- Safety, weather, emergency, or legal concerns; and
- Applicable consumer law.
Approved refunds may exclude non-refundable costs already incurred, including delivery, payment processing, or other disclosed charges, except where prohibited by law.
Rental extensions require approval through the Platform and may require additional payment. Keeping an item beyond the agreed return time without approval may result in late charges, additional rental charges, account restrictions, recovery costs, or legal action.
13. Inspection, Condition Evidence, Damage, Loss, and Theft
Users should inspect and document the item at delivery and return.
Renti-Fi may consider:
- Listing photographs and descriptions;
- Check-in and return photographs or videos;
- Messages and support records;
- Delivery and location records;
- Repair estimates and receipts;
- Replacement cost and depreciation;
- Police or insurance reports;
- Manufacturer or technician findings; and
- Other relevant evidence.
A Renter may be charged for damage beyond ordinary wear and tear, missing components, excessive cleaning, unauthorized repair, misuse, loss, theft, or failure to return the item.
Charges should reflect reasonable repair, replacement, recovery, administrative, or related costs, subject to applicable law.
Owners must not submit exaggerated, fraudulent, duplicate, or unsupported claims. Renters must not conceal or misrepresent damage, loss, or misuse.
14. Accidents, Injury, and Safety
Users assume responsibility for selecting, operating, transporting, storing, and using rented items safely.
Renti-Fi does not guarantee that an item is free from defects or appropriate for a particular User or purpose.
In an emergency, contact emergency services first. Users must promptly notify Renti-Fi and the other relevant party of an accident, injury, dangerous defect, theft, or material incident.
Nothing in these Terms excludes liability that cannot legally be excluded.
15. Disputes Between Users
Owners and Renters should first attempt to resolve issues through the Platform.
Renti-Fi may, but is not obligated to:
- Request documents or evidence;
- Facilitate communication;
- Temporarily hold funds;
- Issue or deny refunds or adjustments;
- Apply deposits or payment authorizations;
- Restrict accounts or listings; or
- Make a platform determination based on reasonably available evidence.
Renti-Fi's internal decision does not prevent a User from pursuing rights available under applicable law.
Failure to cooperate, provide requested evidence, or respond within stated deadlines may affect the outcome.
16. Chargebacks and Payment Disputes
Before filing a chargeback, Users should contact Renti-Fi support and allow a reasonable opportunity to investigate.
A fraudulent or abusive chargeback may result in collection activity, reversal of credits, suspension, termination, or recovery of costs, where permitted by law.
Owners acknowledge that earnings may be reversed or withheld when the underlying renter payment is refunded, disputed, reversed, fraudulent, or subject to chargeback.
17. Communications and Messaging
The Platform may allow Users to communicate about listings and bookings.
You may not use communications to:
- Harass, threaten, discriminate, defraud, or abuse;
- Send spam or unlawful marketing;
- Exchange unlawful content;
- Collect personal information for unrelated purposes;
- Circumvent Platform fees or protections;
- Arrange prohibited off-platform transactions; or
- Introduce malware or malicious links.
Renti-Fi may review, retain, moderate, or disclose communications where permitted by law for support, safety, fraud prevention, policy enforcement, or legal compliance.
18. Reviews and User Content
Users may submit listings, photographs, videos, reviews, messages, support content, and other materials ("User Content").
You retain ownership of your User Content, but grant Renti-Fi a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, display, publish, distribute, and use it as reasonably necessary to operate, improve, protect, and promote the Platform.
You represent that your User Content:
- Is accurate and not misleading;
- Does not violate law or another person's rights;
- Does not contain malware;
- Does not disclose personal information without authority; and
- Is not fraudulent, defamatory, obscene, threatening, or abusive.
Reviews must reflect genuine experiences. Renti-Fi may remove, decline, or moderate content that violates these Terms.
19. Intellectual Property
The Platform, including its software, design, databases, trademarks, logos, text, graphics, and other content provided by Renti-Fi, is owned by or licensed to Renti-Fi and is protected by applicable intellectual property laws.
Renti-Fi grants you a limited, revocable, non-exclusive, non-transferable license to use the Platform for its intended purpose.
You may not:
- Copy, modify, distribute, sell, lease, sublicense, or commercially exploit the Platform;
- Reverse engineer or attempt to extract source code except where law expressly permits;
- Scrape, crawl, index, or access the Platform through unauthorized automated means;
- Bypass security or access controls;
- Remove proprietary notices; or
- Use Renti-Fi branding without permission.
20. Third-Party Services and Links
The Platform may rely on or link to third-party services, including payment processors, identity verification providers, mapping services, analytics providers, cloud hosting, delivery providers, app stores, and external websites.
Third-party services are governed by their own terms and privacy policies. Renti-Fi is not responsible for third-party services beyond obligations imposed by law.
21. Prohibited Conduct
You may not:
- Commit or facilitate fraud, theft, money laundering, or unlawful activity;
- Create false accounts, fake listings, fake reviews, or misleading transactions;
- Use stolen payment credentials or another person's identity;
- Circumvent payment, delivery, verification, safety, or dispute procedures;
- Solicit payment outside the Platform for a Platform-originated booking;
- Manipulate prices, deposits, ratings, referrals, promotions, or payouts;
- Harass, threaten, discriminate against, or exploit another person;
- Interfere with Platform operation or security;
- Upload malware or conduct unauthorized testing;
- Harvest personal information;
- Use bots or automated tools without authorization;
- Violate intellectual property, privacy, publicity, or other rights;
- Abuse refunds, chargebacks, promotions, or claims processes; or
- Encourage another person to do any of the above.
22. Suspension and Termination
Renti-Fi may investigate, restrict, suspend, deactivate, or terminate an account, listing, booking, payment, wallet, payout, or Platform access where Renti-Fi reasonably believes there is:
- A violation of these Terms;
- Fraud, theft, abuse, or safety risk;
- Unpaid amounts;
- A legal or regulatory requirement;
- A chargeback or payment risk;
- False or unverifiable information;
- Misuse of the Platform; or
- Risk to Users, Renti-Fi, or third parties.
Where appropriate, Renti-Fi may provide notice and an opportunity to respond. Immediate action may be taken where necessary for safety, fraud prevention, legal compliance, or protection of the Platform.
Termination does not eliminate obligations or liabilities arising before termination.
23. Account Deactivation and Deletion
Users may request account deactivation or deletion through available account settings or by contacting Renti-Fi.
Renti-Fi may retain information where reasonably necessary for:
- Active or disputed bookings;
- Payments, taxes, accounting, and fraud prevention;
- Legal obligations;
- Safety and enforcement;
- Establishing, exercising, or defending legal claims; and
- Backup and system integrity.
Deletion may not immediately remove information already shared with another User or lawfully retained by a service provider.
24. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."
RENTI-FI DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.
RENTI-FI DOES NOT WARRANT THAT:
- LISTINGS OR USER INFORMATION ARE ACCURATE;
- AN ITEM IS SAFE, DEFECT-FREE, LEGAL, AVAILABLE, OR SUITABLE;
- A USER WILL PERFORM AS AGREED;
- THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; OR
- A DISPUTE, DELIVERY, PAYMENT, OR RENTAL WILL HAVE A PARTICULAR OUTCOME.
Some jurisdictions do not allow certain disclaimers, so some provisions may not apply to you.
25. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTI-FI AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL PROPERTY LOSS, OR LOSS OF OPPORTUNITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTI-FI'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE PLATFORM, A RENTAL, OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT OF PLATFORM FEES PAID BY YOU TO RENTI-FI DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
- US $100.
These limitations do not apply to liability that cannot legally be limited, including where applicable liability for gross negligence, willful misconduct, fraud, or certain personal injury claims.
26. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Renti-Fi and its owners, affiliates, officers, directors, employees, contractors, and agents from claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable legal fees arising from or related to:
- Your use or misuse of the Platform;
- Your listing, rental, possession, delivery, transport, or use of an item;
- Your User Content;
- Your violation of these Terms or law;
- Your violation of another person's rights;
- Damage, loss, injury, or death caused by your act or omission; or
- Taxes, permits, licenses, insurance, or regulatory obligations for which you are responsible.
This section does not require indemnification for Renti-Fi's own conduct where prohibited by law.
27. Insurance
Unless Renti-Fi expressly states otherwise in writing, Renti-Fi does not provide insurance for Users or listed items.
Owners and Renters are responsible for determining whether they need property, liability, renter, homeowner, business, vehicle, equipment, or other insurance.
A User must not assume that an existing policy covers peer-to-peer rentals.
28. Taxes
Users are responsible for taxes, filings, permits, registrations, and reporting obligations arising from their Platform activity, except taxes that Renti-Fi is legally required to collect, remit, or report.
Renti-Fi may collect tax information, issue tax forms, withhold amounts, or provide transaction data where required by law.
29. Electronic Communications
You consent to receive electronic records and communications relating to the Platform, including account notices, booking updates, receipts, policy notices, and legal disclosures.
Marketing communications are subject to applicable consent and opt-out rights.
You are responsible for maintaining a current email address and phone number.
30. Mobile Application Terms
When you download the App from Apple App Store or Google Play:
- These Terms are between you and Renti-Fi, not the app store;
- The app store has no responsibility for the Platform or listed rentals;
- Your use must comply with applicable app-store terms;
- The app store may be a third-party beneficiary of the mobile-app provisions where required by its terms; and
- Renti-Fi, not the app store, is responsible for maintenance and support to the extent required by law.
31. Governing Law
Except where consumer law requires otherwise, these Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
32. Dispute Resolution and Venue
Before filing a formal claim, you agree to contact Renti-Fi at office.rentifi@renti-fi.com and provide a written description of the dispute. The parties will attempt in good faith to resolve the matter informally for at least 30 days.
Unless applicable law permits or requires another forum, any court proceeding must be brought in the state or federal courts located in Loudoun County, Virginia, and each party consents to their jurisdiction.
Optional arbitration clause: Renti-Fi should not publish a binding arbitration or class-action waiver unless reviewed and approved by qualified U.S. counsel.
33. Changes to the Platform or Terms
Renti-Fi may modify the Platform and these Terms.
When required, Renti-Fi will provide notice of material changes through the Platform, by email, or by another reasonable method.
The updated Terms will state their effective date. Continued use after the effective date constitutes acceptance where permitted by law.
34. General Provisions
- Entire agreement. These Terms, the Privacy Policy, booking details, and incorporated policies form the agreement between you and Renti-Fi regarding the Platform.
- Severability. If a provision is unenforceable, the remaining provisions remain effective.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without written consent. Renti-Fi may assign them in connection with a merger, financing, reorganization, sale, or transfer of business.
- No agency. These Terms do not create an employment, agency, partnership, franchise, or joint venture relationship between Renti-Fi and a User.
- Headings. Headings are for convenience only.
- Survival. Provisions that should reasonably survive termination will survive, including payment obligations, intellectual property, disclaimers, liability limits, indemnification, disputes, and general terms.
